Tetra Laval welcomes the ECJ decision

On 15 February 2005 the European Court of Justice announced its decision on the Commission’s appeal in the Tetra Laval/Sidel case against the judgment from the European Court of First Instance.

The Commission’s appeal is directed at issues of legal principle, such as the amount of convincing evidence the Commission must bring if it wishes to block mergers under its jurisdiction. These issues are important for future practice under the Merger Control Regulation. - We are pleased to learn about the European Court of Justice’s decision, which confirms the conclusions of the Court of First Instance. Although we have not yet had time to analyse the decision in detail it seems to us to be a clear decision. We are of course happy that this matter, which has been ongoing since 2001, has finally come to an end, says Tetra Laval’s spokesperson, Mr Jörgen Haglind.
