Tetra Laval appeals against the European Commission's decision Tetra Laval has today lodged an appeal with the Court of First Instance of the European Communities in Luxembourg against the European Commission's decision to prohibit its acquisition of Sidel. On October 30, 2001, the European Commission ruled that the acquisition of Sidel by Tetra Laval was incompatible with the EC Merger Regulation. In its appeal, Tetra Laval claims that the European Commission has not shown that the merger will lead to the alleged negative "conglomerate effects" resulting from the parties' presence in the carton packaging and in the PET packaging equipment markets. Furthermore, Tetra Laval considers that the Commission has failed to demonstrate credibly why the remedies offered by Tetra Laval did not eliminate the Commission's concerns.
