Arctic Gold AB: The Department of Justice should review how Plan og Bygningsloven should be interpreted
Arctic Gold has today been informed that Formanskapet (the advisory committee) in the municipality of Kautokeino has decided to postpone the confirmation of the Arctic Gold Planprogram (program for impact study). The intention is to first let Justitiedepartementet review how Plan og Bygningsloven (the planning and building law) should be interpreted and used.
The municipality of Kautokeino, which previously announced that they would process Arctic Gold's revised proposal for a Planprogram on December 10, 2012, has once again sent a request to Miljöverndepartementet (the Environmental Protection Agency in Norway) for an interpretation of Plan og Byggningsloven. This took place after Arctic Gold had let one additional legal firm in Norway give their viewpoint on the interpretation of the law. The lawyer who handled the case for Arctic Gold had previously been a contributing creator of the law in question. Miljöverndepartementet has therefore decided to forward the question for review at Justicedepartementet. While awaiting the reply from the departments the Kautokeino municipality chose to postpone the processing of Arctic Golds plan program.
- I have previously stated the importance of making decisions after collecting all the relvant facts and therefore consider it correct that the municipality is treating the matter seriously and consults with the highest authority. It is important to gain total certainty on the interpretation of the law before the case is further handled by the municipal goverment, says CEO Lars-Åke Claesson in a comment about the decision in Kautokeino.
