Artimplant applies for its own bankruptcy

The Board of Directors and the CEO of Artimplant AB (publ) have decided to apply for its own bankruptcy. The reasons behind the insolvency and the liquidity problems are related to the ongoing litigations in the USA, where Artimplant has been sued by approx. 50 patients who claims they have been injured by the CMC Spacer, and the ongoing Arbitration in Sweden, which has been initiated by Artimplant to determine which insurance company or insurance broker are responsible for each claim related to the litigations in the USA. Artimplant and Tiller signs an agreement

Artimplant AB (publ) and Tiller International Capital have today entered into an agreement regarding a Sales, Marketing and Distribution Agreement which will gives Tiller the exclusive right to sell, market and distribute all Artimplant´s products outside Europe and non exclusively within Europe. The Board has decided to put back the Annual General Meeting and the first Interim Report for 2013 from May 7 to May 30, 2013. Artimplant prolongs its funding agreement regarding costs for trials in USA, recovers previous costs for the trials and requests for arbitration

Artimplant and the two insurance companies involved and the insurance broker have prolonged the funding agreement entered into during the summer of 2012 which purpose is to fund Artimplant’s costs for the trails in USA until a final solution is reached to divide the liability amongst the parties. Artimplant postpones Year-End Report

The Board of Directors has decided to postpone the publication of Artimplant's Year-End Report until February 27, 2013. US study of Artelon® Tissue Reinforcement in repair of rotator cuff tears published

Dr Thomas Marberry at Tulsa Bone & Joint Associates, Tulsa, Oklahoma, USA, has published a study on challenging rotator cuff tears. The study demonstrates a beneficial outcome from the use of Artelon® Tissue Reinforcement (ATR).The tears are graded as large or massive and the patients selected for the study had poor tissue quality, which meant that it was difficult to achieve a lasting repair with suturing alone. New Head of Research and Development at Artimplant

Katrin Gisselfält is stepping down as Head of Research and Development at Artimplant to take up a position at another company. Lars Peterson will take over as Head of Research and Development until a suitable permanent solution has been found. Lars Peterson has been a member of the Artimplant Board of Directors since 2011. He is also emeritusprofessor at the Sahlgrenska Academy, Gothenburg University, and he conducts research into tissue regeneration. Artimplant receives ongoing funding for costs related to lawsuits in the U.S.

Artimplant has previously announced its assessment that there is adequate insurance coverage for all injuries alleged in the ongoing trials in the U.S. However it is currently unclear if it falls under Artimplant former or current insurance provider. In the meantime, while the liabilities are determined, an agreement has been made to ensure that Artimplant, for the foreseeable future, receives funding for the costs Artimplant has to run the lawsuits.
