IVO has appealed the Administrative Court’s decision to grant suspension of IVO's decision to revoke Humana Assistans AB's permit

The Swedish Health and Social Care Inspectorate ("IVO”) has today, 14 February 2023, appealed to the Administrative Court of Appeal in Stockholm against the decision made by the Administrative Court to grant suspension to of IVO's decision to revoke Humana Assistans AB's ("Humana Assistans") permit to conduct business with, among other things, personal assistance.  For IVO's appeal to be heard, the Administrative Court of Appeal must first grant permission to appeal. If this happens, the Administrative Court of Appeal shall then urgently examine whether the suspension decision should be revoked. At present, Humana Assistans has no information when the Administrative Court of Appeal's will announce its decision regarding permission to appeal or the question of revoking the suspension. Should the Administrative Court of Appeal revoke the suspension decision, it means that IVO's decision that Humana Assistans’ operations shall cease should be enforced, even though the legal process regarding the permit continues.

Humana announced on 31 January 2023 that IVO had decided to revoke Humana Assistans' permit to conduct operations. On 2 February 2023, Humana announced that Humana Assistans’ had appealed the decision to the Administrative Court of Appeal in Stockholm and filed a request for suspension. On 7 February 2023, Humana announced that the Administrative Court had granted a suspension, which means that Humana Assistans can continue to conduct operations until further notice while continue to pursue the substantive issue is decided in court.

IVO has today, 14 February 2023, appealed to the Administrative Court of Appeal in Stockholm against the decision made by the Administrative Court to grant suspension to of IVO's decision to revoke Humana Assistans AB's ("Humana Assistans") permit to conduct business with, among other things, personal assistance.  For IVO's appeal to be heard, the Administrative Court of Appeal must first grant permission to appeal. Humana Assistans still consider IVO's decision incorrect, for reasons including those stated in Humana's press release on 2 February 2023.  The company will continue to work for safe and secure personal assistance for all customers while continuing to pursue the case in court.
