The Administrative Court in Stockholm grants Humana Assistans AB's appeal against IVO's decision to revoke Humana Assistans' permit

The Administrative Court in Stockholm (the "Administrative Court") has today, 21 June 2023, announced that they grant Humana Assistans AB's (“Humana Assistans”) appeal against the Swedish Health and Social Care Inspectorate’s (“IVO”) decision to revoke Humana Assistans' permit to conduct operations with, among other things, personal assistance. The Administrative Court's ruling means that IVO's decision to revoke Humana Assistans' permit shall not be enforced. IVO can appeal the Administrative Court's decision to the Administrative Court of Appeal no later than 12 July.  For IVO's appeal to be heard, the Administrative Court of Appeal must first grant permission to appeal.

The Administrative Court has today, 21 June 2023, announced that they grant Humana Assistans' appeal against IVO's decision of 31 January 2023, to revoke Humana Assistans' permit to conduct operations.

The Administrative Court’s decision means that IVO's decision to revoke Humana Assistans' permit shall not be enforced, and that Humana Assistans can continue its operations.

The Administrative Court has examined all the deviations cited by IVO and concluded that several of the deficiencies are of date long back in time, have not been sufficiently investigated and that there have been reasonable explanations and interpretations for several of the deviations. All in all, it is not clear that the company and its representatives no longer meet the requirements for suitability.

IVO has the possibility to appeal the Administrative Court's decision to the Administrative Court of Appeal no later than 12 July, after which the Administrative Court of Appeal must first grant permission to appeal before the issue can be processed.

IVO's decision to revoke Humana Assistans' operating license on January 31, 2023 has led to negative effects in the form of a reduced number of assistance customers and increased consulting costs. The customer reduction, so far, amounts to approximately 16%. Increased consultancy costs, so far, amount to approximately SEK 30m.

The Group's other business areas, or the Group’s other personal assistance operations, are not directly affected by a possible discontinuation of the operations of Humana Assistans.  

The decision from IVO covers the personal assistance operations run by Humana Assistans, whose annual net revenue and operating profit, in the first quarter 2023, amounted to SEK 806m and SEK 23m, respectively, corresponding to approximately 33% of the Group's net revenue and approximately 23% of the Group's operating profit. Net revenue and operating profit for the personal assistance business area as a whole within the Humana Group, in the first quarter 2023, amounted to SEK 849m and SEK 26m, respectively, corresponding to approximately 35% of the Group's net revenue and approximately 26% of the Group's operating profit.
