Baker & McKenzie rådgivare vid biogasprojekt

Stockholm den 21 december - Baker & McKenzie har varit rådgivare till GoBiGas (Gothenburg Biomass Gasification) i en ansökan till EU kommissionen om prövning av ekonomiskt stöd från Svenska staten avseende ett biogasprojekt för att skapa andra generationens biobränsle (statstödsprövning).

EU-kommissionen har efter statsstödsprövning beviljat ett forsknings- och utvecklingsstöd på 222 miljoner kronor* till GoBiGas projektet för produktion av biogas. Projektet går ut på att genom termisk förgasning av biobränsle och spill från skogsbruket skapa andra generationens biodrivmedel.

Baker & McKenzie Advokatbyrå har under processen agerat rådgivare till GoBiGas och dess projektgrupp som letts av Åsa Burman vid Göteborg Energi och bestått av experter från Göteborg Energi och EON med Owe Jönsson som ansvarig. Baker & McKenzies team har letts av advokat Leif Gustafsson, advokat och delägare på Stockholmskontoret, med biträde av Nina Niejahr vid Baker & McKenzies kontor i Bryssel. Tillsammans med Mattias Ganslandt, som rådgivit i ekonomiska frågor, har gruppen arbetat nära varandra vilket är en del av bakgrunden till resultatet. Ett gott stöd från Näringsdepartementet och Johnny Kjellström samt Statens Energimyndighet har också underlättat arbetet som även präglats av en god kontakt med och förståelse från kommissionens tjänstemän.

- Detta är en stor framgång för vår växande praktik med inriktning på statligt stöd i Bryssel och Stockholm och vi är förstås glada över godkännandet. Genom hårt arbete och samordnade ansträngningar i teamet och ett obrutet stöd från GoBiGas och myndigheterna kunde vi få detta i hamn innan årsskiftet. En bidragande orsak var att vi lyckades få kommissionens engagemang tidigt i processen och ett gehör för våra argument i ett av de första statstödsärendena under den nya EU-regim som etablerades 2006.  På det hela har det varit en positiv och givande erfarenhet, säger Leif Gustafsson.

- Beslutet visar att med erforderlig kompetens i ett tidigt skede av processen kan komplexa och stora projekt med betydande belopp i statligt stöd som är föremål för fördjupad undersökning, erhålla godkännande från kommissionen inom rimlig tid, tillägger Nina Niejahr. GoBiGas förståelse för komplexiteten har även varit en god grund för ett gott samarbete och ett gott resultat.

Förgasningsanläggningen kommer att kunna följas av en större anläggning planerad att genomföras efter utvärdering av den första etappen om upp till 10 år inom GoBiGas. Kostnaderna för detta 10-åriga FoU-projekt kommer att bli omkring 1 miljard kronor**. Projektet kommer att ledas av Göteborg Energi AB, huvudägare i GoBiGas, med stöd av sin partner E.ON Gasification Development AB, ett dotterbolag till E.ON Sverige AB.

Baker & McKenzie Assists in EU Approval for State aid to SEK978 million (€105 million) Pre-Commercial Pilot for the Production of Bio-Methane

Brussels, Belgium, 21 December 2010 – Baker & McKenzie assisted Göteborg Energi AB, the Swedish Energy company, throughout the pre-notification and notification process before the EU Commission in relation to Sweden’s grant of SEK 222 million (€24 million) to the Gothenburg Biofuels Gasification (GoBiGas) project.  This 10-year project for the development and construction of a pre-commercial pilot plant for the production of bio-methane will involve total investment costs of approximately SEK 1 billion (€110 million).

Baker McKenzie led by Leif Gustafsson, partner in our Stockholm office, and the State aid expert Nina Niejahr, counsel in our European Competition Law Center in Brussels worked closely with the GoBiGas team, headed by Åsa Burman from Göteborg Energi working in tandem with the co-investor E.ON through E.ON Gasification Developments’ Owe Jönsson. Economist Mattias Ganslandt of CELEC, who was instrumental in presenting the project’s eligible costs base and underlying financial and economic assumptions.  Given the significant amount of State support, it was subject to detailed assessment under the Commission’s 2006 Framework for State aid for research, development and innovation.  But already on 14 December 2010, in less than six months following notification after an intensive and constructive pre-notification dialogue, the Commission granted approval. 

The Commission approval in this case underscores the favourable view that the Commission takes towards well targeted aid by Member States to pre-commercial pilot plants that require large investments to develop cutting-edge new technologies, particularly in the areas of climate change and energy.  This is important in view of the ongoing first call for proposals for “NER 300” support, the EU’s funding for innovative renewable energy technology and carbon capture and storage project from the New Entrants’ Reserve of the European Emissions Trading Scheme.  Most NER 300 supported projects will require co-financing by EU Member States, which will be subject to separate State aid control and approval by the Commission.  For the implementation of these projects timely State aid approval will be critical.

This is the first of four projects that Sweden is funding to support the development of technologies for the production of 2nd generation biofuels in line with the Commission’s 2009 Communication "Investing in the Development of Low Carbon Technologies", which recognized the need for significant amounts of public financing in this area to meet the EU's 2020 CO2 reduction targets.  The GoBiGas pilot plant will develop a technology for indirect gasification of low-quality forest raw material into bio-methane, producing approx 16 MNm3 per year to be injected in the existing gas grid on a continuous basis. This will likely be the first demonstration in one of the priority areas identified for piloting and demonstration in the Commission’s European Strategic Energy Technology Plan (also known as the SET Plan).

Åsa Burman comments that having secured Commission approval is an achievement of great importance not only to the region and Sweden but also to the development of renewable energy sources in Europe. Leif agreed “this is a significant step forward in enabling the technological development in the area of renewable energy in Europe and for our growing State aid practice in Brussels and Stockholm.  It shows that we are well positioned to assist companies with the State aid control aspects of renewable energy projects, including NER 300-funded projects.”  “Timely approval was made possible by the coordinated team effort, including the leadership of Johnny Kjellström, Deputy Director at the Swedish Ministry of Enterprise, Energy and Communications and the Swedish Energy Agency.  By engaging the Commission’s case team early on in the process and they were open to consider certain complex issues and related arguments, which was a particularly rewarding experience.  This indicates that with the involvement of the required level of legal and economic State aid control expertise from an early stage, timely parallel approval of State aid for projects identified for NER 300 funding can be achieved”, added Nina.
