Avanquest Sued Over Rigged Diagnostic Tools

A putative class action lawsuit filed against Avanquest NA Inc. in a California federal court alleges that the software company manipulated its customers into purchasing its products using a rigged diagnostic software tool that always indicated the need for system repair on the customer’s computer.

Lead plaintiff Benson Worley alleges in the suit that Avanquest’s System Suite PC Tune-up & Repair, which was available on a yearly subscription basis, was programmed to indicate, without performing any legitimate evaluation, the existence of non-existent errors in the system, according to Law360 (subscription needed). The customer was then encouraged to buy the company’s software to fix the nonexistent problems.

Claims leveled against the company by the plaintiff include breach of express warranty, fraudulent inducement, breach of contract, and violation of the principles of fair dealing and good faith.
