Biomet Hip Plaintiffs File Move for MDL Coordination

Two plaintiffs in a product liability lawsuit have petitioned the Judicial Panel on Multidistrict Litigation (JPML) to consolidate all pending lawsuits over the Biomet M2a Hip implant to the Northern District of California or the Southern District of New York.

The plaintiffs claim that they have been injured because of a failed M2a Magnum artificial hip device, according to court documents. Their lawsuit is among nine other similar complaints that are pending in six federal districts across the U.S.

The M2a Magnum is a complete metal-on-metal hip replacement system. Such hip implant systems and their rate of failure and injury to patients have been the subject of growing media and legal attention.

The plaintiffs claim that the Food and Drug Administration received at least 450 adverse event reports regarding the medical devices. They further say that the number of patients experiencing injuries “will grow rapidly and that hundreds of M2a Magnum cases will be filed in federal courts.”

The M2a Magnum device is just one of many metal-on-metal hip implants that prompted litigation. DePuy’s ASR device is another metal-on-metal hip implant that has been the center of controversy and has led to thousands of lawsuits.
