Flushmate Sued Over Exploding Toilets

Flushmate has been hit with a class action consumer fraud lawsuit that claims it withheld information about defects in their toilets that could lead to them exploding.

United Desert Charities claims that the company failed to accurately design and assess the Series 503 Flushmate III Pressure-Assist Flushing System and promoted the product as being “trouble free” while failing to inform the public of the possibility for leaks, ruptures and even explosions, according to Law360 (subscription required).

“Defendants made numerous material omissions relating to the design, reliability, and performance of the Flushmate system,” the complaint states.

The consumer fraud lawsuit comes just as the Consumer Product Safety Commission issued a recall of 2.3 million Flushmate mechanisms, according to Law360 (subscription required). There were 304 reports of product malfunctions, including “impact or laceration” injuries.
