General Dynamics Sued Over Gun Malfunction

Defense contractors Alliant Techsystems Inc. and General Dynamics Corp. were sued by a former U.S. Army soldier whose lawsuit claims that they are liable for the alleged malfunction of a machine gun that caused him to suffer severe injuries while serving in Afghanistan.

Plaintiff Sean P. McMahon alleges he was test-firing the Browning M2 .50 caliber machine gun when it malfunctioned, which caused a .50 caliber shell casing to penetrate his right calf, according to Law360 (subscription required). The incident caused him to experience injuries that required multiple surgeries.

The product liability lawsuit claims that McMahon developed deep vein thrombosis and that he was diagnosed with tinnitus and hearing loss related to the incident, according to Law360. McMahon also argues that Alliant and General Dynamics failed to provide proper safety precautions for the machine guns and that they were improperly designed and manufactured.
