Personal Injury Lawsuit Filed Over ATV Accident

A Georgia woman filed a personal injury lawsuit against the maker of a Polaris ATV after an accident left her severely injured.

Amber Glisson alleges that Polaris Industries failed to properly warn consumers about the dangers their ATV posed. She says that she was riding as a passenger in a 2009 Polaris Ranger RZR, when her hair became caught in the rotating drive shaft that controls the vehicle’s wheels, according to Courthouse News.

“While riding in the ATV, with full face helmet buckled on and safety belt strapped, Amber's hair became caught in the unguarded and unprotected rotating drive shaft which is below the passenger seat, the force of which scalped her (medically referred to as a scalp avulsion) and fractured one or more discs of her spine, fractured ribs and caused her other serious bodily injury,” states the complaint.

The personal injury lawsuit claims that Polaris failed to warn riders and passengers that the drive shaft under the passenger compartment was exposed. It further states that the company decided to use an unsafe model of the ATV when safer models were available.

Glisson says she has incurred hundreds of thousands of dollars in medical expenses and is now permanently disfigured and scarred. She seeks damages for failure to warn, product liability, pain, negligence, suffering and medical expenses.
