Woman Receives $80,000 from Delta Airlines for Spider Bite

A woman received $80,000 from Delta Air Lines Inc. for a venomous spider bite she claimed she received while travelling to an international destination on the airline.

Law 360 (subscription required) reported that the woman alleges in her complaint that she had to undergo several surgeries after receiving the brown recluse spider bite and sought $175,000 as compensation. She argued that the bite was an “accident” according to international rules that govern injuries during a flight.

The woman alleged she received permanent scarring and disfigurement from the spider bite. She sought compensation for her medical expenses in her demand letter along with strict liability under the Montreal Convention, and emotional distress, according to Law360.

The Montreal Convention states that an airline is liable for the injury of a passenger if the accident that caused the injury took place on board the aircraft or while embarking or disembarking.
