Will new Italian President be a Notary or a Ruler?

Following the appointment of Sergio Mattarella as the new Italian President, Professor Mauro Tebaldi’s analysis of the growing powers of former President Giorgio Napolitano during the 2010 – 14 crisis, and his impact on Italian democracy, has now become even more germane.

During the period of political and economic crisis in Italy, the President of the Republic became the central institutional actor of the Italian parliamentary government; viewed as a vehicle for internal stability by some, deemed democracy’s worse enemy by others. The key questions remain: were Napolitano’s actions legal or unconstitutional? And did they strengthen or weaken Italian democracy?

This is what Professor Tebaldi sets out to discover by honing in three key areas of investigation: the traditional nature of presidential powers in Italy; Napolitano’s behaviour in regards with the Italian crisis; and the potential decline of the Italian parliamentary system as a direct result of his conduct.

By meticulously examining the President’s term, the article shows that Napolitano played a role that the political parties and their leaders could not perform and analyses the consequences of the change from a 'notary' to a 'ruler' type of Presidency in Italy.

While it’s unarguable Napolitano heightened his authority, was his intervention legitimate? And did it really weaken the Italian democracy?
