Wallenstam won in Supreme Court Regarding: a buyer should not have to pay stamp duty on so-called VAT certificates. Case no. Ö 2085 - 98. In spring, 1997, Wallenstam acquired a combined residential and commercial property in central Gothenburg. When Wallenstam applied at the Gothenburg District Court for registration of title to the property with the land registration authority, the company was required to pay stamp duty on the VAT certificate. Wallenstam disputed this since it regarded the payment of tax on a VAT payment to be unreasonable. Wallenstam felt that its standpoint was supported by the law and accordingly appealed the decision. After considering the appeal, the Supreme Court has now found in favour of Wallenstam. This decision is important and will have a precedential effect in the future and serve as guidance when similar cases are determined at land registration authorities around the country.
