Trademark Clearing House opens for registration March 26, 2103

ICANN has announced the launch date for the Trademark Clearinghouse to March 26, 2013. The purpose of the Trademark Clearing House (TMCH) is to protect intellectual property rights when the new generic Top Level Domain (gTLDs) program will be launched.  The clearing house will be open to all trademark holders and will be operated by Deloitte (performing the verification services) and IBM (providing the database). In Article 15 in the Council Regulation it is stated that a CTM has to be put into use in the Community within a five-year period following the registration. If it is not put into use during this time, it can be subject to revocation. ICANN’s list of “Early warnings” to requested new top domains now listed

ICANN (Internet Corporation for Assigned Names and Numbers) is now evaluating the almost 2,000 applications for new generic Top Level Domains which have been filed. Countries/State authorities have the possibility of objecting to applications if they are in conflict with current national laws or if they are sensitive or problematic for other reasons. For instance, they may object to applications if they consider the applications to potentially harm consumers. ICANN's Governmental Advisory Committee has now published a list of 'Early Warnings' to about 250 of the applications submitted

Matters for brand owners to consider when Croatia joins the EU in July 2013

Brand owners need to consider a number of matters relating to current and future IP rights. Existing CTMs and RCDs filed before July 1, 2013 Registrations and applications filed before or claiming priority before July 1, 2013 will be extended to Croatia (so called “extended CTM or RCD”). The holder does not have to take any action, it will be automatically extended on July 1 and will have equal effect in Croatia. New Chinese Top IDN Level Domains open for registration
